This policy sets out how Energy Skills Ltd A.C.N. 656 241 600 or its Associated Entities (referred to herein as Energy Skills Ltd, ESL, we, us, our and similar grammatical forms) trading under any business name, trading name, mark or trademark as may be registered from time to time handles your Personal Information. This includes Personal Information collected via all programs, products, websites, applications, online platforms and associated digital services that we own, operate, or have the right to operate from time to time (including without limitation Jobs in Energy, Worker Pathways, and SkillPASS) (collectively the ESL Platforms) and all funds that we establish and maintain.

  • By providing information to us and/or using the ESL Platforms after viewing this Privacy Policy, you accept the terms of this Privacy Policy and consent to our collection, use, disclosure, retention and protection of your Personal Information as described in this Privacy Policy.
  • We appreciate that your privacy is important to you, we will continue to protect the Personal Information you provide us and we will manage your Personal Information in compliance with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs).
  • We will take all reasonable steps to ensure that all information we collect, use or disclose is accurate, complete, up-to-date and stored in a secure environment.
    • When do we collect information?
      • We collect three categories of information when you provide it to us, whether through your use of the ESL Platforms or otherwise:
        • The Personal Information you voluntarily provide — that is, we collect Personal Information with your informed consent, including when you:
          • Submit information through the ESL Platforms, for example:
            • We will collect Personal Information from you when you register in the ESL Platforms or fill out a form related to any customer service feature operating in the ESL Platforms;
            • When registering in the ESL Platforms you will need to provide certain details so that we can establish and manage your customer account;
          • Deal with us face-to-face or in writing (by letter, facsimile, or email) or by telephone;
          • Participate in any of our events or promotions, or subscribe to any of our publications;
          • Submit an application, quote, purchase order and/or service request to us; and
          • In the course of supplying products and services to you, or through our other dealings with you;
        • Anonymous non-personal information about how you use the ESL Platforms; and
        • Cookie based information and similar tracking technologies that make your use of the ESL Platforms easier by recording your preferences;
      • We may also, with your permission, collect Personal Information in the form of your entire Unique Student Identifier (USI) vocational education training (VET) transcript (USI VET Transcript) in the form of a government authenticated document from the Student Identifiers Registrar;
      • In some cases we may also collect your personal information from publicly available records, our Associates, or non-related third parties. The circumstances where we collect your personal information from third parties may include:
        • From AirCV;
        • From an Industry Partner;
        • From your employer, in relation to products or services we supply to your employer as our contractor or as our customer;
        • From an individual or entity who may be providing services to you as our contractor;
        • From a third party who supplies us with products or services, including our suppliers, agents and advisors;
        • From a third party (such as a trade referee or credit reporting body) to assist us in assessing your application for credit. For example, to verify the information you have provided to us or to assess your circumstances;
        • Where we need information from your current or former employer to assist us in assessing your job application or expression of interest as a contractor;
        • From a third party to assist us in locating or communicating with you; and
        • From a third party to otherwise assist us in supplying you with products or services.
    • Why do we need to collect Personal Information?

We collect Personal Information when you volunteer that information in order to receive a service from us. The Personal Information collected will be shared across the ESL Platforms and with AirCV and used to provide the services you have requested or may request from us.  Your Personal Information may be used to set up and manage your subscriptions across the ESL Platforms. Your Personal Information may be used to tailor your service needs.  Your personal information may also be used for the promotion of:

  • Registered training organisations (and their training and funding);
  • Programs (such as Women in Electricity); and
  • Conferences (including conferences conducted by third-parties), including of a commercial nature,

as well as in relation to any survey, marketing, promotional offer or any competition you may enter with us (including in the ESL Platforms).

  1. What information do we collect?
    1. The type of information we collect from you will depend on what services you ask us to provide (whether in the ESL Platforms or otherwise), or use (or ask to have the right to use) in the ESL Platforms. The Personal Information we may collect includes your name, postal address, physical address, email addresses used by you or in connection with you, for example, by your employees, Associates and Associated Entities, telephone numbers, Facebook and LinkedIn Profile URLs, details of your qualifications, work experience and continuing qualification development, contact details, information for identification purposes, your curriculum vitae (including AirCV), continuing professional development record, your USI, your USIVETTranscript, and detailed job descriptions;
    1. We may also collect records of your communications and interactions with us, details relating to your use of our products and services, records of your application to us as a potential employee or contractor, records relating to your engagement, conduct, hours worked, and payment as an employee or contractor and your ABN and/or government related identifiers, such as tax file numbers if you are engaged by us as an employee or contractor;
    1. General information about visits to the ESL Platforms is collected by our computer servers, with Cookies that the ESL Platforms transfer to your computer or mobile device’s hard drive (if you allow the delivery of Cookies). Cookies are used to follow the pattern of movements of users by letting us know which pages in the ESL Platforms are visited, in what order and how often. The anonymous non-personal information that we collect and analyse is not Personal Information as described in the Privacy Act.
    1. Why do we use Cookies and other web use tracking technologies?
      1. We collect information using Cookies and other tracking technologies for the following reasons:
        1. To help us monitor the performance of the ESL Platforms so that we can improve the operation of the ESL Platforms and the services we offer;
        1. To provide personalised services to each user of the ESL Platforms to make their navigation through the ESL Platforms easier and more rewarding to the user;
        1. To sell advertising in the ESL Platforms in order to meet some of the costs of operating the ESL Platforms and improve the content in the ESL Platforms; and
        1. To market the services we provide as well as events, training, conferences and other commercial opportunities provided by us or third-parties to you by sending emails, push notifications, text messages and in-app messages that are personalised to you;
      1. You can, at any time, decide not to receive further emails, text messages and in-app messages from us and will be able to “unsubscribe” from those services;
      1. If you are unhappy about having a Cookie sent to you, you can set your browser to refuse Cookies or choose to have your computer or mobile device warn you each time a Cookie is being sent. However, if you turn your Cookies off, some of our services may not function properly.
    1. How do we store your information?
      1. We use different technologies and procedures to help protect Personal Information from unauthorised access, loss, alternation, disclosure or use. We use Google Cloud and the Stripe payment processing platform. Our commitment to data security means:
        1. We have procedures to limit access to Personal Information within our organisation;
        1. We use security measures and technologies within our organisation to protect your Personal Information; and
        1. We use service providers that can establish that they have secure controls relating to software security, access security and network security, including where credit card information is being transferred.
  1. What use and disclosures do we make of your Personal Information?
    1. The purposes for which we may use and disclose your personal information will depend on the services we are providing to you;
    1. We will use and disclose your Personal Information for administration and management, including:
      1. Communicating with you in relation to the management of your subscriptions across the ESL Platforms;
      1. Administering billing and payments and debt recovery;
      1. Planning, managing, monitoring and evaluating our services;
      1. Quality improvement activities;
      1. Statistical analysis and reporting;
      1. Training staff, contractors and other workers;
      1. Obtaining advice from consultants and other professional advisers;
      1. Marketing and promotion of our and our Industry Partners’ services;
      1. Responding to enquiries and complaints regarding our services; and
      1. For other purposes explained at the time of collection or otherwise;
    1. Your Personal Information will be shared across the ESL Platforms, and with our website and community talent host (including AirCV), through the use of Application Programming Interfaces (APIs) to ensure that your Personal Information remains synchronised and up to date across the ESL Platforms and within AirCV;
    1. Personal Information may also be shared with our Associates or Associated Entities;
    1. We may send you information and updates about any other product, service or information that we provide to you;
    1. We may send you occasional news and information about other products, services, events, training, funding, programs, conferences and special promotional offers, including those of our Associates or Associated Entities, our Industry Partners, Registered training organisations and third parties;
    1. We may send you survey, marketing and promotional offers from us, our Associates, our Associated Entities, our Industry Partners and third parties;
    1. If at any time you would like to stop receiving future commercial messages from us, we include detailed unsubscribe instructions at the bottom of each email, text message or in-app message;
    1. We may disclose information to third parties we engage in order to provide our services, including contractors and service providers used for data processing, data analysis, customer satisfaction surveys, information technology services and support, website maintenance or development, printing, archiving, mail-outs, and market research;
    1. We may also release your Personal Information when we believe release is appropriate to comply with the law, enforce our subscription agreements, our policies and terms of use, or protect ours or others’ rights, property, or safety;
    1. We will notify you if we become aware that we may be required to disclose Personal Information by law or to the Office of the Australian Information Commissioner (OAIC).
    1. Do we disclose your personal information overseas?
      1. We work with clients, service providers, sponsors and commercial interests across the globe. It is possible that your personal information will be disclosed to overseas recipients;
      1. Unless we have your consent, or an exception under the APPs applies, we will only disclose your personal information to overseas recipients where we have taken reasonable steps to ensure that the overseas recipient does not breach the APPs in relation to your personal information.

      1. You are able to have access to, and correct, the Personal Information we hold about you;

    1. Our privacy officer will first consider your complaint to determine whether there are simple or immediate steps which can be taken to resolve the complaint. We will generally respond to your complaint within a week;

If your complaint requires more detailed consideration or investigation, we will acknowledge receipt of your complaint within a week and endeavour to complete our investigation into your complaint promptly. We may ask you to provide further information about your complaint and the outcome you are seeking. We will then typically gather relevant facts, locate and review relevant documents and speak with individuals involved;
    1. In most cases, we will investigate and respond to a complaint within 30 days of receipt of the complaint. If the matter is more complex or our investigation may take longer, we will let you know;

The ESL Platforms may include links to internet sites operated by third parties. We have no responsibility or liability for the content and activities of these linked sites. Nonetheless, we seek to protect the integrity of and welcome any comment about linked sites. Those websites are not subject to our Privacy Policy and you should review the privacy policies of each of those other websites to assess whether they are suitable prior to using them.

By providing information to us and/or using the ESL Platforms after viewing this Privacy Policy, you consent to this Privacy Policy and our use and storage of your Personal Information as provided herein.

  1. Changes to our Privacy Policy
    1. If we decide to change this Privacy Policy, we will post those changes on our website, and update the Privacy Policy modification date below;

    1. Definitions
      1. In this Privacy Policy the following terms shall have the following meanings unless the context otherwise requires:
        1. AirCV means the online platform known as AirCV through which job seekers create a searchable online profile of their curriculum vitae;
        1. Associate has the meaning given to it in sections 10 to 17 of the Corporations Act (Cth);
        1. Associated Entity has the meaning given to it in sections 50AAA of the Corporations Act (Cth);
        1. Content means any materials or content on the ESL Platforms or that contribute to the existence and the “look and feel” of the ESL Platforms, including information, graphics, headers, icons, images, logos, names, brand names, service names, sounds, music, video, audio, text, software, HTML and code;
        1. Cookies has the meaning commonly ascribed to that word in the information technology industry and includes but is not limited to scripts and tags such as Google Tag Manager and otherwise for tracking, local storage, tracking pixels and technologies, device fingerprints and user consent methodologies for, among other purposes, measuring engagement, performance, improving website functioning and performance and marketing and promotion of our and Industry Partners’ services;
        1. Industry Partner means an organisation from industry or government with whom we have partnered to further our mission to promote the Queensland energy, mining, renewable and telecommunications industries as a career of first choice, encourage investment in skills and training and increase the number of skilled workers in the industry and also means our professional advisers, including our lawyers and accountants;
        1. Intellectual Property Rights includes patents, rights to inventions, copyright, trade marks, data, trade names and domain names, rights in goodwill, rights in confidential information and any other intellectual property rights, whether registered or unregistered and including all applications for, and renewals or extensions of, such rights and all similar rights which subsist now or in future anywhere in the world;
        1. Jobs in Energy means all products and services bearing the Job in Energy branding/name and includes, but is not limited to, the application Jobs in Energy, the website at www.jobsinenergy.com, web applications, desktop applications and all Content;
        1. Personal Information has the meaning given in section 6 (1) of the Privacy Act 1988 (Cth);
        1. SkillPASS means all products and services bearing the SkillPASS branding/name and includes, but is not limited to, the application SkillPASS, the website at www.skillpass.com.au, web applications, desktop applications and all Content; and
        1. Worker Pathways means all products and services bearing the Worker Pathways branding/name and includes, but is not limited to, the application Worker Pathways, the website at www.workerpathways.com.au, web applications, desktop applications and all Content.
